Future Intelligence™ Terms and Conditions
Effective date: September 9, 2026
Welcome to Future Intelligence. These Terms and Conditions (the "Terms") are a legal agreement between you and WTCHY,INC a Delaware C Corp (dba "Future Intelligence," "we," "us," or "our"). They cover the Future Intelligence app on iOS, Android, and the web; the website at futureintelligence.app; our live sessions; and everything else we offer through them (together, the "Service"). Apple and Google call this document a Terms of Use or End User License Agreement (EULA). It serves that purpose here.
By creating an account, subscribing, or using the Service, you agree to these Terms and to our Privacy Policy at which is part of this agreement. If you don't agree, please don't use the Service.
The short version
This summary is here to help. The full Terms below are what govern.
Future Intelligence is an inner training app. It's a wellness and educational product, not medical care, therapy, or a crisis service.
The practices involve breathing, movement, and meditation. Talk to your doctor first if you have a health condition, and stop if anything feels wrong.
Some of the app is free. Premium is a subscription that renews automatically until you cancel it through the store or site where you bought it.
Your journal and reflections belong to you and are private.
The videos, meditations, teachings, and method belong to us and our partners. Use them for your own practice; don't copy, record, resell, or teach from them.
You need to be 18 or older to use the Service.
In live sessions, be respectful, and keep what other members share confidential.
Delaware law applies, and our liability to you is limited as described in Section 16.
1. What Future Intelligence is, and isn't
What it is. Future Intelligence is a structured inner training program delivered as an app. You log how you're feeling and how strongly you're feeling it, optionally record a heart rate variability (HRV) reading, and the app guides you through a short practice — breathing exercises, movement, meditations, and teaching videos — designed to help you regulate and return to center. The Service also includes a private journal, a dashboard showing your patterns over time, optional live group sessions, reminders, and support features such as "Ask a Question."
What it isn't. Future Intelligence is an educational and wellness product. It is not medical care, mental health treatment, psychotherapy, or counseling, and it isn't a substitute for any of these. We do not diagnose, treat, or prevent any disease or condition. Nothing in the Service — including teachings, practices, HRV feedback, descriptions of your nervous-system state, or answers from our team or automated tools — is medical, psychological, or other professional advice. The app is designed for everyday emotional regulation. It is not designed to work through trauma or to replace individualized psychological care. If you have a mental health condition, are in treatment, or are working through trauma, use the Service alongside your care, not instead of it, and follow your provider's guidance.
Emergencies. The Service is not monitored for emergencies and is not a crisis resource. If you are in crisis, are thinking about harming yourself or someone else, or need urgent help, call 911 (in the U.S.), call or text 988 (the Suicide & Crisis Lifeline in the U.S.), or contact your local emergency services immediately.
2. Your health and safety
The practices in the Service involve physical activity, breathing techniques, stillness, and sustained attention to your emotional state. You are responsible for deciding whether they're appropriate for you.
Check with your doctor first if you are pregnant; have a heart, blood pressure, or respiratory condition; have a history of seizures, fainting, or panic attacks; have had recent surgery or an injury; or have any physical or mental health condition that could be affected by breathwork, movement, or meditation.
Stop immediately if you feel dizzy, faint, short of breath, in pain, or emotionally overwhelmed in a way that feels unsafe. Rest, and seek medical attention if symptoms continue.
Never practice while driving, operating machinery, in or near water, or in any situation where a loss of focus or balance could hurt you or someone else.
Go at your own pace. Modify or skip any movement that doesn't feel right for your body.
Biometric readings. HRV and other readings you enter or import come from your own device or wearable. We don't verify them. The Service is not a medical device, and any description of your nervous-system state is general wellness feedback based on the readings you provide.
You use the practices at your own risk. To the extent permitted by law, you accept the risks of physical and emotional discomfort or injury that can come with any exercise, breathing, or meditation practice.
3. Your account
Age. You must be at least 18 years old to use the Service. [NOTE: adjust if you decide to allow 13–17 with parental consent; this changes your privacy-law obligations.]
Accuracy and security. Give us accurate information when you sign up and keep it current. Keep your login credentials private, don't share your account, and tell us right away at [support@futureintelligence.app] if you think someone else has accessed it. You're responsible for activity on your account. If you sign in with a third-party account (for example, Google or Apple), that provider's terms also apply to the sign-in.
One account per person. Please don't create multiple accounts or an account for someone else.
4. Free features, Premium, and billing
Free and Premium. Some parts of the Service are free. Others, which we label as Premium, require a paid subscription. What's included in each may change over time as we add and refine content.
Price. The price of a Premium subscription is shown before you subscribe. Prices may vary by region, platform, and currency, and may include applicable taxes.
Where you're billed. Depending on how you subscribe, you'll be billed by:
Apple, through your Apple account, if you subscribe in the iOS app;
Google, through your Google Play account, if you subscribe in the Android app; or
our payment processor, if you subscribe on our website.
Apple and Google subscriptions are also governed by their terms and policies. We don't have access to your payment details on those platforms.
Automatic renewal. Premium subscriptions renew automatically at the end of each billing period (monthly, unless stated otherwise) at the then-current price, until you cancel. Your payment method is charged at the start of each new period.
Cancelling. You can cancel anytime:
Apple: open your Apple ID settings, choose Subscriptions, and cancel Future Intelligence.
Google Play: open the Play Store, go to Subscriptions, and cancel Future Intelligence.
Website: cancel from your account settings or email us at [support@futureintelligence.app].
Deleting the app does not cancel your subscription. Cancellation takes effect at the end of your current billing period, and you keep Premium access until then.
Refunds. If you subscribed through Apple or Google, refunds are handled under their policies and must be requested from them; we aren't able to issue App Store or Google Play refunds ourselves. If you subscribed on our website, payments are non-refundable except where the law requires otherwise [NOTE: or describe any refund window you want to offer], but if something has gone wrong, email us and we'll try to make it right.
Free trials and promotions. We may offer free trials, introductory periods, or other promotions, including periods when Premium features are available at no charge. Unless we say otherwise, a free trial converts to a paid subscription when the trial ends unless you cancel before then. Promotions are subject to the terms stated at the time, are limited to one per person unless we say otherwise, have no cash value, and may be changed or ended at any time.
Referral rewards. Our Grow Together referral program lets you share the Service with people you know. If someone signs up using your referral link, you and/or they may receive a complimentary period of Premium or another reward described at the time. Rewards are applied as described, can't be exchanged for cash, and may be withheld or reversed if we see abuse (for example, self-referrals, fake accounts, or spamming). We may change or end the program at any time.
Price changes. We may change subscription prices. We'll give you notice before a price change affects you, through the store you subscribed on or by email, and you can cancel before it takes effect.
5. Your content
Your journal is yours. You own what you create in the Service: journal entries, reflections, voice notes, and questions you submit (your "Content"). We don't claim ownership of any of it.
It's private. We designed the journal and your reflections to be private to you. We don't read your journal entries except when you ask us to (for example, for support), when it's necessary to fix a technical problem, when we reasonably believe it's needed to protect someone's safety, or when the law requires it. [NOTE: confirm this matches how access actually works on your platform.]
Your emotion logs, HRV readings, and usage data are used to personalize your practice and to run and improve the Service. When we study this data, we use it in aggregated or de-identified form — for example, to learn which practices help most with which feelings. We don't share your individual logs, readings, or journal entries with other members or the public. Our Privacy Policy explains this in detail.
Sharing. The Service may offer features that let you create a card or image about your practice and post it outside the app. Sharing is always your choice. Once you share something outside the Service, we can't control where it goes.
The license you give us. So that we can run the Service for you, you give us a limited, non-exclusive, worldwide, royalty-free license to store, process, back up, transmit, and display your Content, solely to provide, secure, and improve the Service and as described in our Privacy Policy. This license ends when you delete your Content or your account, except for copies that remain in routine backups for a limited time and for anything you've already shared publicly.
Your responsibility. You're responsible for your Content. Don't submit anything you don't have the right to share, anything that infringes someone else's rights, or anything unlawful.
6. Our content and intellectual property
What we own. Everything in the Service other than your Content — including videos, audio, meditations, teachings, scripts, breathing and movement sequences, music, text, images, illustrations, the design and structure of the app, the emotion wheel, the Future Intelligence method and curriculum, the name Future Intelligence™, and the fi* logo — belongs to Future Intelligence or to the practitioners, artists, and partners who license their work to us ("Our Content"). Our Content is protected by copyright, trademark, and other laws.
Your license to use it. While you follow these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable license to access and use Our Content through the Service for your own personal, non-commercial practice.
What you can't do. You may not:
copy, download (except through features we provide), record, screen-capture, transcribe, or redistribute Our Content;
sell, rent, sublicense, or publicly perform or display Our Content;
use Our Content to teach, coach, lead sessions, or provide services to others, including in a workplace, studio, or with clients, without a written license from us;
use Our Content or the Service to train, fine-tune, or build artificial intelligence or machine learning models, or to build a competing product;
remove or alter any copyright, trademark, or other notice;
reverse engineer, decompile, or attempt to extract the source code of the Service; or
share your account or let anyone else use your access.
If you'd like to bring Future Intelligence to your team, organization, or clients, contact us at concierge@futureintelligence.app about a business license.
Trademarks. Future Intelligence™, the fi* logo, and our other names and marks are our trademarks. You may not use them without our written permission.
Copyright complaints. If you believe content in the Service infringes your copyright, email concierge@futureintelligence.app with a description of the work, where it appears in the Service, and your contact details.
7. Acceptable use
Use the Service for what it's built for: your own practice. Don't:
break any law or violate anyone's rights;
harass, threaten, demean, or impersonate anyone, including in live sessions;
interfere with the Service or its security, including probing, hacking, introducing malware, or circumventing access controls or payment systems;
access the Service with bots, scrapers, or other automated means, or at volumes a person wouldn't generate;
use the Service to provide services to others without our written permission; or
help anyone else do any of the above.
8. Live sessions
We may offer optional live group sessions (such as Practice Hours) by video call.
Respect. Be kind. We may remove anyone who is disruptive, disrespectful, or unsafe for others.
Confidentiality. What other members share in a session is theirs. Don't record, screenshot, or repeat what others share, and don't attach anyone's name to what they said outside the session.
Recording. We may record sessions for members who couldn't attend or for internal review, and we'll tell you at the start of a session if it's being recorded. [NOTE: keep or remove depending on whether you record.]
Not therapy. Sessions are group practice led by a facilitator. They are not group therapy, medical care, or a substitute for professional support. Sections 1 and 2 apply.
Scheduling. We may change, reschedule, or cancel sessions. Sessions are hosted on third-party platforms (such as Zoom) under those platforms' terms.
9. Messages and notifications
With your permission, we send push notifications — for example, a daily reminder to check in — which you can turn off anytime in your device settings. We'll email you about your account, purchases, and important changes to the Service, and we may send you updates and offers, which you can unsubscribe from at any time. Essential service messages (such as billing or security notices) are sent as long as you have an account.
10. Third-party services and devices
The Service works with third-party services, including app stores, payment processors, hosting and infrastructure providers, video-call platforms, and, if you choose to connect one, wearables and health apps (such as Garmin or Apple Health). Those services have their own terms and privacy practices, which govern your use of them. We rely on data from wearables as it's provided to us and aren't responsible for its accuracy or availability, or for any third-party service.
11. If you downloaded the app from the Apple App Store
These additional terms apply, and Apple requires them:
These Terms are between you and Future Intelligence, not Apple. Apple isn't responsible for the app or its content.
Your license to the app is limited to use on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
Apple has no obligation to provide maintenance or support for the app. We're responsible for that.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price you paid for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.
If a third party claims that the app infringes its intellectual property rights, we, not Apple, are responsible for investigating, defending, settling, and discharging the claim.
You represent that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
You must comply with any applicable third-party terms when using the app.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Questions, complaints, or claims about the app can be sent to us at the address in Section 20.
Google Play. If you downloaded the app from Google Play, your download and any purchases are also subject to the Google Play Terms of Service. Google is not a party to these Terms and isn't responsible for the app.
12. Feedback and early-access features
If you send us feedback, suggestions, or ideas, including through "Ask a Question," you agree we can use them without restriction or compensation. We may offer beta or early-access features that are unfinished and may change or be removed at any time. If we tell you a feature is confidential, please keep it that way.
13. Changes to the Service and to these Terms
The Service. We're always working on Future Intelligence. We may add, change, or remove content, practitioners, features, or pricing tiers at any time. The library and practices you see today may differ from what's available later.
These Terms. We may update these Terms from time to time. When we do, we'll post the new version with a new effective date, and for material changes we'll also notify you in the app or by email before they take effect. If you keep using the Service after a change takes effect, you accept the updated Terms. If you don't agree, stop using the Service and cancel your subscription before the change takes effect.
14. Ending your account
By you. You can stop using the Service and delete your account at any time from your account settings or by emailing us. Deleting your account doesn't automatically cancel a subscription made through Apple or Google; cancel that separately (see Section 4).
By us. We may suspend or terminate your account, with or without notice, if you violate these Terms, if your use creates risk or legal exposure for us or others, or if we discontinue the Service. If we discontinue the Service entirely, we'll give reasonable notice where practical and, where required by law or by the applicable store's policies, refund any prepaid but unused portion of your subscription.
After termination. Your license to Our Content ends, you lose access to the Service and to your Content in it, and Sections 5, 6, 12, and 15 through 19 (and anything else that by its nature should survive) continue to apply. We'll handle your data as described in our Privacy Policy.
15. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
No guaranteed results. Inner training works differently for different people. Any outcomes we describe, including changes in emotional state, HRV, calm, energy, or behavior, are the reported experiences of members and clients, not promises. We don't guarantee that the Service will produce any particular result for you.
General, not personal. The content and any answers from our team or automated tools are general in nature and aren't tailored to your medical or psychological situation.
Availability. We don't guarantee that the Service will be uninterrupted, error-free, or secure, or that any content will remain available.
Some jurisdictions don't allow certain warranty exclusions, so some of the above may not apply to you.
16. Limitation of liability
To the fullest extent permitted by law:
Future Intelligence and its owners, officers, employees, contractors, practitioners, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to the Service or these Terms, however caused and under any theory of liability, even if we've been advised of the possibility of such damages.
Our total liability for all claims arising out of or related to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) US $100.
These limits don't apply to liability that can't be limited by law, including liability for our fraud, willful misconduct, or gross negligence. Some jurisdictions don't allow certain limitations of liability, so some of the above may not apply to you.
17. Indemnification
You agree to defend, indemnify, and hold harmless Future Intelligence and its owners, officers, employees, contractors, practitioners, and licensors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your Content, your violation of these Terms, or your violation of anyone else's rights.
18. Governing law and disputes
Delaware law applies. These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-laws rules.
Talk to us first. If you have a dispute with us, email concierge@futureintelligence.app and we'll try to work it out informally. Each of us agrees to try in good faith to resolve any dispute this way for at least 30 days before starting a legal proceeding.
Where disputes are heard. Any dispute that isn't resolved informally will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you and we consent to the personal jurisdiction of those courts. [NOTE: your lawyer may recommend an arbitration clause and class-action waiver instead of court; that's a decision for you.]
Your consumer rights. Nothing in these Terms limits any rights you have under the consumer protection laws of the place where you live that can't be waived by agreement.
19. Other terms
Entire agreement. These Terms, our Privacy Policy, and any additional terms we provide for specific features or offers are the entire agreement between you and us about the Service.
Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
No waiver. If we don't enforce a provision, we can still enforce it later.
Assignment. You may not transfer these Terms or your account to anyone else. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
No third-party beneficiaries, except Apple as described in Section 11.
Force majeure. We're not responsible for delays or failures caused by events outside our reasonable control.
Export. You'll comply with all applicable export control and sanctions laws in using the Service.
Notices. We may notify you by email to the address on your account or through the Service. Notices to us go to the addresses in Section 20.
Language and headings. These Terms are written in English. Headings and the summary at the top are for convenience only and don't affect interpretation.
